After you reach the age of 59 1/2, you may begin taking withdrawals from your 401. If you leave your job in the calendar year when you turn 55 or later, you can also begin taking penalty-free withdrawals from the 401 you had with that current company. If you are a public safety worker, this rule takes effect at the age of 50.
Once you reach 72, you are actually obligated to begin making required minimum distributions or RMDs.
The Costs Of Early 401k Withdrawals
Early withdrawals from an IRA or 401k account can be an expensive proposition because of the hefty penalties they carry under many circumstances.
The IRS allows penalty-free withdrawals from retirement accounts after age 59 ½ and requires withdrawals after age 72 . There are some exceptions to these rules for 401ks and other qualified plans.
Try to think of your retirement savings accounts like a pension. People working towards a pension tend to forget about it until they retire. There is no way they can access it before retirement. While that money is locked up until later in life, it becomes a hugely powerful resource in retirement. The 401k can be a boon to your retirement plan. It gives you flexibility to change jobs without losing your savings. But that all starts to fall apart if you use it like a bank account in the years preceding retirement. Your best bet is usually to consciously avoid tapping any retirement money until youve at least reached the age of 59 ½.

Can I Borrow From My 401k To Buy A House
Youre allowed to take out a loan from your 401k or IRA. You will be borrowing money from yourself and then paying yourself back with interest.
The 401k loan will be required to be paid back, usually automatically deducted from your paychecks. It has a tax advantage over a typical early withdrawal from your 401k without paying it back.
When you withdraw early, you will be charged a 10% tax penalty. If you get a loan and promise to repay the amount, you will not be charged a penalty tax.
As with any loan, interest accumulates on the amount borrowed. However, since it is your money, the interest is paid back to yourself, added to your 401k balance, and not paid to a lender.
You will need to talk to your plan administrator about a hardship withdrawal to purchase a home.

As a Divorce Financial Strategist I am frequently asked, “Can I take money out of my 401K before/during my divorce?”
Or sometimes it is asked like this, “Can my spouse take money out of his/her 401K before or during our divorce?”
The short answer is, “It depends.”
Typically, the amount in a 401K plan that is accumulated during a marriage is considered martial property. In Equitable Distribution states, this means that the amount in the account should be divided according to what is “fair and equitable.” In Community Property states, 401K funds accumulated during the marriage are divided in accordance with that state’s laws . However, a potential issue is that funds might be withdrawn by the account holder before or during the divorce . If you are concerned that your spouse may try to take a loan or withdraw funds from his/her 401K, you can contact the plan’s sponsor and see if they will flag the account to prevent any loans or withdrawals without first notifying you. They might be able to do so, if the plan allows it.
Once the funds have been transferred using a QDRO, you own them and can start making additional contributions and invest the proceeds as you see fit. At this point, your ex-spouse has no control over how you handle the account.

Is It A Good Idea To Use Your 401k To Buy A House
Before we jump into how to invest your 401k in real estate, letâs answer one important question. Itâs possible to use 401k money in real estate investing, but is it actually a good idea to do so? Here are the pros and cons to consider:
Advantages of Investing Your 401k in Real Estate
When mortgage interest rates rise, a 401k loan can provide cost-effective access to money. With interest rates just above the prime rate on most 401k loans, this can be an affordable option to cover a large down payment on an investment property. And while weâre on the subject of interest, hereâs another benefit of borrowing from your 401k for a down payment: as you pay back your 401k loan, youâre repaying yourself with interest which is going back into your 401k account.
Finally, another reason why you might want to invest your 401k in real estate is the tax exemption that comes with 401k loans. When you borrow from your 401k, there are no tax consequences and no tax-related fees. For example, when you withdraw from an IRA to put a down payment on an investment property, youâll have to pay income taxes on the distribution. However, because the money you borrow from your 401k is a loan, you donât need to pay income taxes on it. As a matter of fact, it doesnât count as income at all.
Disadvantages of Investing Your 401k in Real Estate
What Are The Penalties Fees Or Taxes Involved In Borrowing From Your 401
If you borrow the money, youll be required to repay the loan, typically within 5 years. Youll be paying interest while you do it, which is generally at the interest rate of 2 points over the prime rate. But the interest will be used to pay yourself, which makes it a bit less onerous. However, remember these loans are paid with after-tax dollars so youre missing out on the tax benefits that make 401 accounts so attractive in the first place.
And note that if you use a 401 loan and then leave your job, the full amount must be repaid before you file taxes for the year in which you left your job . If you dont, its considered a withdrawal, which means it will be taxed at ordinary income tax rates.

Alternatives To Drawing From Your 401 To Buy A House
If youre stretching to buy a house and you dont have the capital outside of a retirement plan, it begs the question: can you afford to buy the house? Pareto said. Its best to build up your other savings accounts before you buy a house. Maybe minimize what theyre contributing to the 401 until they can sure up capital.
McBride agrees. If you dont have a demonstrated track record of saving money, thats something you want to establish before you take the plunge into homeownership, he said. Buying before youre financially ready can really limit your financial capabilities. Everything about owning a home costs money.
But, he said, even if you have small balances in your savings accounts, you may still be eligible to buy a home with a down payment smaller than the standard 20 percent.
Saving For A Rainy Day
Theres nothing like a new home to keep the rain at bay. Save for it. Many people save for three to 10 years before buying a house. Setting up a separate savings account and gradually building up enough for a down payment is a great idea. Even in the midst of saving for a home, most people who are working will continue contributing to their employers saving plan, especially when the employer provides matching contributions. When prioritizing, it may be best to set aside an amount for your retirement accounts, and then determine an amount for your house.

If you havent saved for a down payment, though, you might be considering other ways to get access to the money you need now, including your 401. Thats because some 401 plans let you borrow money from your retirement savings and pay it back over time.
But even if you arent planning to retire any time soon, taking a loan from your 401 can come with big drawbacks, like missing out on potential investment growth. So before you dip into your nest egg, consider if its really the best option for you.
Are There Other 401 Options
Withdrawal is not the only way to access 401 funds for a down payment.
Your benefits provider may also offer 401 loan options. If available, this option not only helps you avoid the early withdrawal penalty fee, but also paying income tax on your withdrawal.

Best for: First-time homebuyers who need $10,000 or less for a down payment
You normally need to be 59½ to take penalty-free distributions from your IRA, but the IRS allows an exception for qualified first-time homebuyer distributions.
As long as you put any early distributions of up to $10,000 toward buying or building your first home, you wont have to pay the additional 10% tax on it.
How To Take Money Out Of Your 401
There are many different ways to take money out of a 401, including:
- Withdrawing money when you retire: These are withdrawals made after age 59 1/2.
- Making an early withdrawal: These are withdrawals made prior to age 59 1/2. You may be subject to a 10% penalty unless your situation qualifies as an exception.

Avoiding PMI with a 20% down payment
Lets say youre buying a $300,000 home with a $30,000 down payment with a 5% rate for 30 years. You will be required to carry private mortgage insurance because youre putting less than 20% down. Your monthly payment will be $1,449.42, including insurance, property taxes, and PMI of $112.50 monthly.
If you can borrow another $30,000 from your 401k account, you will have a $60,000 down payment, 20% of the purchase price. You avoid PMI and have a monthly mortgage payment of $1,288.37, a savings of $161.05 per month over 30 years, saving you $57,978 over the life of the loan.
