First off, what you can invest in with an IRA or 401 is defined not by what is allowed, but what is not allowed.

In general the only things not allowed are life insurance contracts and collectibles .

Meanwhile, cryptocurrency, being an investment property for tax purposes, is not expressly prohibited as an investment option, and thus can be considered an allowable investment for retirement accounts.

While the above is true, you need specific types of accounts to be able to invest due to other rules that end up prohibiting cryptocurrency .

Given the above, without going into detail, the bottomline here is that you need either a self-directed IRA or a Solo 401 to invest in cryptocurrency through a retirement account.

The self-directed IRA one is a little more straight forward, what you need to do is 1. either set up an IRA limited liability company to purchase investment property , or 2. set up a Bitcoin IRA with a custodian like BitcoinIRA.com .

So is it doable? YES. Is it easy? NO or simple not really .

Substantially equal period payments SEPPs) can also be a good option to rely on when you need to cash out some money from your 401, but without paying the penalty fee. These withdrawals cannot be done if you are still working for the employer that sponsors your 401 plan, but if you get the funds out through an IRA, then you can make these withdrawals at any time you want.

If you need money in the short term, the SEPP may not be an ideal choice to go for. Once you start making payments for this kind of withdrawal, you can expect to have to pay for at least five years on it, or until you hit 59 and a half whichever comes first.

If you dont make these payments, the penalty for early withdrawal will apply, and youll also be asked to pay interest on the deferred penalties over the past couple of tax years.

There are two exceptions to this rule. The first exception is when the taxpayer dies, allowing for beneficiary withdrawals. The second exception is when the taxpayer becomes disabled permanently.

It may be better to borrow money rather than take a 401 hardship withdrawal. Too many people cash out of a 401 plan or take a hardship withdrawal to pay medical expenses when their 401 money would be protected. Try working out a payment plan before you touch your 401 money.

You are allowed withdrawals of up to $100,000 per person taken in 2020 to be exempt from the 10 percent penalty. If you have more than $100,000 in one of these retirement accounts, note that it is $100,000 per person and not per account. If youre out of work and need income, you might be considering withdrawing from your retirement savings. Normally, if you withdraw money from traditional Individual Retirement Accounts and employer-provided accounts before reaching age 59 ½, you have to pay a 10 percent early withdrawal penalty.

Furthermore, emergency withdrawals from your current employer-provided plans are limited to an amount needed to meet a limited set of approved hardships, like avoiding foreclosure, home repairs after a disaster, or medical expenses.

If the pandemic has had negative effects on your finances, temporary changes to the rules under the CARES Act may give you more flexibility to make an emergency withdrawal from tax-deferred retirement accounts during 2020.

Among other things, the CARES Act eliminates the 10 percent early withdrawal penalty if you are under the age of 59 ½. One third of the money you withdraw will be included as income in your taxes for each of the next three years unless you elect otherwise. The CARES Act also allows you to pay back what you withdrew from your accounts if youre able to do so.

    Different 401 Retirement Options

    Next, let’s look at what choices Owen will have when he retires. The decision will largely be his. The law allows for five different alternatives for a 401 account at retirement. The options include lump-sum distribution, continue the plan, roll the money into an IRA, take periodic distributions, or use the money to purchase an annuity. Owen’s particular plan will allow for some or all of them.

    The fastest way for Owen to get his “big wad” of money is to take a lump-sum distribution. He’ll get the money quickly. But there are two disadvantages. First, he’ll pay ordinary income taxes on the entire amount withdrawn. Second, the money will no longer be growing tax-free.

    If Owen does take a lump-sum distribution, he’ll be subject to 20% withholding. That means the IRS will take 20% of the money distributed now and apply to his tax bill next April. Owen can thank the “Unemployment Compensation Amendments Act of 1992” for that idea.

    Owen could decide to leave the money in the account. It will continue to grow tax-free. That can make a big difference in how much is available to him during retirement. Many retirees choose to spend taxable accounts first saving IRAs and 401s until they need the money or are forced by law to begin distributions.

    Another possibility would be to roll the 401 into an IRA. That would give Owen the largest number of investment options. He could still withdraw the money when he wants or choose to let it grow tax-free.

    Other Options For Getting 401 Money

    If you’re at least 59½, you’re permitted to withdraw funds from your 401 without penalty, whether you’re suffering from hardship or not. And account-holders of any age may, if their employer permits it, have the ability to loan money from a 401.

    Most advisors do not recommend borrowing from your 401 either, in large part because such loans also threaten the nest egg you’ve accumulated for your retirement. But a loan might be worth considering in lieu of a withdrawal if you believe there’s a chance you’ll be able to repay the loan in a timely way s, that means within five years).

    Loans are generally permitted for the lesser of half your 401 balance or $50,000 and must be repaid with interest, although both the principal and interest payments are made to your own retirement account. It is also worth noting that the CARES Act raises the borrowing limit from $50,000 to $100,000. If you should default on the payments, the loan converts to a withdrawal, with most of the same consequences as if it had originated as one.
