Withdrawing From A Roth 401k

Most 401k plans involve pre-tax contributions, but some allow for Roth contributions, meaning those made after taxes already have been paid.

The benefit of making a Roth contribution to your 401k plan is that you already have paid the taxes and, when you withdraw the money, there is no tax on the amount gained as long as you meet these two provisions:

  • You withdraw the money at least five years after your first contribution to the Roth account
  • You are older than 59 ½ or you became disabled or the money goes to someone who is the beneficiary after your death

What If I Inherit A Retirement Qrp

Spouse and non-spouse beneficiaries have several options when they inherit a QRP, including the following:

  • Transfer to an Inherited Traditional IRA
  • Transfer to an Inherited Roth IRA
  • Convert to an Inherited Roth IRA

Additionally, only a spouse could:

  • Rollover to their own IRA
  • Convert to their own Roth IRA

The Labor Department on Monday said it has reached a settlement with Wells Fargo and Company, Wells Fargo Bank and GreatBanc Trust Company a plan trustee that recovers more than $131.8 million for the retirement plans participants after a department investigation found that, from 2013 through 2018, the fund overpaid for company stock purchased for the plan.

Wells Fargo also agreed to pay a penalty of nearly $13.2 million as part of the settlement.

Wells Fargo and GreatBanc entered into the settlement without admitting or denying the allegations made by the department.

Labor Secretary Marty Walsh said Labors investigation found those responsible for Wells Fargos 401 plan paid more than fair market value for employer stock and, by doing so, betrayed the trust of the plans current and future retirees.

The settlement shows the Department of Labor will act when we find retirement assets are misused and benefit plans suffer, Walsh said.

The action follows an investigation by the departments Employee Benefits Security Administration that determined Wells Fargo and GreatBanc Trust Co. caused the 401 plan to pay between $1,033 and $1,090 per share for Wells Fargo preferred stock.

A settlement has been reached after an Employee Benefits Security Administration investigation.

The Department of Labor has reclaimed $131.8 million for Wells Fargo 401 plan participants after an investigation uncovered that a plan trustee overpaid for company stock purchased for the plan from 2013 through 2018.

The DOL reached the settlement with Wells Fargo and Company, Wells Fargo Bank and GreatBanc Trust Company, a trustee to the plan, according to a statement.

Our investigation found those responsible for Wells Fargos 401 plan paid more than fair market value for employer stock and, by doing so, betrayed the trust of the plans current and future retirees, Secretary of Labor Marty Walsh said in a statement. Todays settlement shows the Department of Labor will act when we find retirement assets are misused and benefit plans suffer.

In addition to the recovered funds, Wells Fargo will pay a penalty of nearly $13.2 million as part of the settlement, according to the DOL. Wells Fargo and GreatBanc Trust Company entered the settlement without admitting or denying the allegations against them, a DOL press release says.

The stock, specifically designed for the plan, was converted to a set value of $1,000 in Wells Fargo common stock when allocated to participants. In other words, Wells Fargo and GreatBanc caused the plan to pay more for stock than it was worth when deposited into participants accounts.

One possibility is your employer rolled the funds over into a Default IRA.

If your employer tried to contact you for instructions as to what to do with your account balance, and you fail to respond, you may be deemed a non-responsive participant.

If they are unable to locate you altogether, you may be deemed a Missing Participant.

In either scenario, if the plan is being terminated, your employer may have put the funds in a Missing Participant Auto Rollover IRA.

This is an IRA account set up on your behalf to preserve your retirement assets until they are claimed by you or your beneficiaries under Department of Labor regulations.

To qualify for a Missing Participant or Default IRA, the account balance must be greater than $100 but less than $5,000 unless the funds are coming from a terminated plan, then the $5,000 ceiling is waived.

Finding a Missing Participant IRA

If your money has been transferred to a Missing Participant IRA, you should be able to find it by searching the FreeERISA website.

This search is slightly more time consuming than the national registry. Registration is required to search the database, which contains 2.6 million ERISA form 5500s, covering 1.3 million plans and 1 million plan sponsors.

If you know your money has been transferred to one of these default accounts, you should get it out into a standard IRA account.

Typically, these accounts must be interest-bearing, bear a reasonable rate of return, and be FDIC insured.
