How to Find Unclaimed 401K Money

One possibility is your employer rolled the funds over into a Default IRA.

If your employer tried to contact you for instructions as to what to do with your account balance, and you fail to respond, you may be deemed a non-responsive participant.

If they are unable to locate you altogether, you may be deemed a Missing Participant.

In either scenario, if the plan is being terminated, your employer may have put the funds in a Missing Participant Auto Rollover IRA.

This is an IRA account set up on your behalf to preserve your retirement assets until they are claimed by you or your beneficiaries under Department of Labor regulations.

To qualify for a Missing Participant or Default IRA, the account balance must be greater than $100 but less than $5,000 unless the funds are coming from a terminated plan, then the $5,000 ceiling is waived.

Finding a Missing Participant IRA

If your money has been transferred to a Missing Participant IRA, you should be able to find it by searching the FreeERISA website.

This search is slightly more time consuming than the national registry. Registration is required to search the database, which contains 2.6 million ERISA form 5500s, covering 1.3 million plans and 1 million plan sponsors.

If you know your money has been transferred to one of these default accounts, you should get it out into a standard IRA account.

Typically, these accounts must be interest-bearing, bear a reasonable rate of return, and be FDIC insured.

Consider The Amount Of Money In Your Old 401 Account

Your past employer doesnt have to keep overseeing your 401 account if your balance is less than $5,000.

At less than $1,000, your old company can just write you a check.

If you hold more than $1,000 but less than $5,000 in a 401 account with a company for which you no longer work, you should receive a request for payout instructions from your former employer. If you fail to respond to those instructions, your former company can roll the money into an IRA of its choice.

Still coming up empty? Search for an Employer Identification Number from your former employer on your old tax returns to continue your search online. You can start with the Department of Labors Employee Benefits Security Administration s Abandoned Plan Database.

The Abandoned Plan site should be able to help you determine if your plan was terminated and provide contact details for the administrator.

With an EIN, you may also find help from the Pension Benefit Guaranty Corporations Missing Participants Program. This federal agency insures private plans, so corporations are required to file an annual 5500 with the IRS. Starting in 2018, PBGC began accepting missing participant accounts from terminated 401s. They will pay identified funds to confirmed owners.

When employees leave a company with a defined contribution retirement plan such as a 401, the majority rollover plan benefits to other tax-qualified accounts themselves. A significant number neglect to do so, however, allowing assets to remain in the plan after employment ends. The Economic Growth and Tax Reconciliation Act of 2001 amended the IRS code to allow plan sponsors to establish Rollover IRAs for missing and non-responsive plan participants with balances less than $5000.

In 2004, the U.S. Department of Labor published guidelines establishing safe harbor provisions for rollover distributions that would satisfy the plan sponsors fiduciary responsibilities to participants under ERISA. The plan sponsor must provide information about the automatic rollover process in the Summary Plan Description or Summary of Material Modification given participants. They must enter into a written rollover agreement with an IRA provider stipulating the amount of the initial investment, as well as services to be provided, fees and expenses.

Searching is simple, you can search their database by Plan Name or Employer name, and locate the Qualified Termination Administrator responsible for directing the shutdown of the plan.

Assets May Also Be Temporarily Frozen

Access to your funds, vested or not, may also be blocked if litigation related to the plan is in process. In such instances, assets may be temporarily frozen, Portnoff says. Similarly, according to Rischall, short-term restricted access to your funds may happen in the event the plan sponsor is changing record keepers or there is a blackout period in which funds cannot be changed or accessed in any way. You should know about this in advance, he adds: This is legal, and notices must be provided to active participants at least 30 days prior to the blackout start date.

Recently terminated employees may also be subject to different rules regarding access to their plans. These rules are governed by things such as resolving any lingering financial issues around a workers departurean outstanding loan, for example. If youve taken out a 401 loan and leave your job, youll have a specified time period in which to pay it back.

Finally, a lock may occur due to suspected fraudulent activity on the account. While fraud alerts are meant to protect account holders, sometimes they may be unaware of the alert and will need to call customer service to release the hold.

Taking 401 Distributions In Retirement

The 401 withdrawal rules require you to begin depleting your 401 savings when you reach age 72.

At this point, you must take a required minimum distribution each year until your account is depleted. If you are still working for the employer beyond age 72, you may be able to delay required minimum distribution until you stop working if your plan allows this delay. The delay option is not available to you if you own 5% or more of the business.

You have until April 1 of the year after you turn 72 to take your first required minimum distribution. After that, you must take a minimum amount by December 31 each year. Your 401 plan administrator will tell you how much you are required to take each year.

The amount is based on your life expectancy and your account balance. If you dont take your required minimum distribution each year, you will have to pay a tax of 50% of the amount that should have been taken but was not. If you participate in more than one employer plan, you must take a required minimum distribution from each plan.

What To Do When You Find An Old 401

Once youve reconnected with your old 401, its time to decide what to do with it:

  • Leave it with your old employer. If you contributed at least $5,000 to your old 401, you might consider leaving it where it is. But this may only be worthwhile if the account has competitive fees or offers access to unique investments. Otherwise, itll be yet another account to keep track of come retirement, and you may be better off rolling it over.
  • New 401 rollover. Has your new employer offered you a 401? Consider consolidating your retirement funds by rolling your old retirement account into a new 401.
  • IRA rollover. If you dont have a new 401 to move your old retirement funds into, consider rolling over into an individual retirement account. That way, your funds retain their tax-advantaged status.
  • Cash it out. Consider this a last resort because cashing out a 401 ahead of schedule can result in major penalties.
  • If youre older than 59 ½, you can access funds without penalty.
  • If youre under 59 ½, withdrawals are subject to a 10% tax penalty and other fees.

Where To Find Unclaimed Money

The kind of unclaimed money may affect the type of database you need to search in or the state agency you need to contact.

Unfortunately, this is a state-by-state issue, says Warren Ward, CFP, founder of WWA Planning and Investments in Columbus, Indiana. I know of no national database.

So for many types of unclaimed money or property, youll need to search your states records.

In Indiana you can visit indianaunclaimed.gov, a site maintained by the attorney generals office, says Ward. Its actually something we do every year for our clients, but its very easy to do for an individual if they care.

Ward cautions about treasure hunters contacting you out of the blue and offering to find lost money for you.

The claiming process is now automated, but we still hear of people cruising the database for large amounts of money and trying to get people to pay them to locate the funds, he says.

So if someone contacts you about finding unclaimed money, it may be a tip-off that you have funds out there somewhere. That means you should initiate a search yourself. You can conduct a search for free at any of the state websites and neednt pay anyone to find money for you.

Even if your former employer abandoned its retirement plan, your money isnt lost forever. The U.S. Department of Labor maintains records for plans that have been abandoned or are in the process of being terminated. Search their database to find the Qualified Termination Administrator responsible for directing the shutdown of the plan.

Finding Old Retirement Accounts

You may want to start by contacting your former employers and the plan administrators, the companies that ran the retirement plan. Sometimes, youll find that your retirement account is still there and chugging along as is, hopefully growing in value over time. If you want, you may be able to leave it there, although update the company with your current contact information so it can let you know about any important changes.

However, its not always that easy. If your account had less than $5,000 in it when you left, the plan administrator can transfer the funds to an individual retirement account that was set up in your name. If it had less than $1,000, the company may have tried to send you a check for the amount to the address it had on file. You may also have trouble tracking down the account if the company went bankrupt or switched plan administrators, leaving it up to you to figure out who is holding onto the money now.
