What If Your Employer Goes Out Of Business
Under federal law, your employer must keep your 401 funds separate from their business assets.
This means that even if your employer abruptly shuts their doors overnight, your money is protected. It cannot be used to pay off your companys loans, cover employee payroll, or for any other purpose.
If your company shut down abruptly, it is possible that a portion of money will be at risk. If your money has been withheld, but has not yet been sent to the 401 plan to be invested, the company could in theory, access those funds.
Contact The 401 Plan Administrator
If your employer is no longer around, try getting in touch with the plan administrator, which may be listed on an old statement.
If youre unable to find an old statement, you still may be able to find the administrator by searching for the retirement plans tax return, known as Form 5500.
You can find a 5500s by the searching the name of your former employer at www.efast.dol.gov.
If you locate a Form 5500 for an old plan, it should have the contact information on it.
Where Is My 401
When you leave your employer you have three options for the money youâve accumulated in your old 401 account. You can either:
- Leave it alone and keep it in the same account
- Roll over the funds to your new employerâs 401 plan or
- Roll over the funds to an IRA.
Most people leave their 401âs alone, either from neglect or they donât bother with facilitating the transfer.
You can rollover your old 401 funds to an IRA as soon as youâd like. If your IRA is already set up then it can accept the funds immediately.
However, if your new employer implements a waiting period before you can participate in their 401 program, then you have no choice but to leave it alone until youâre eligible.
This is where things fall through the cracks. Unattended 401âs can end up in a few different places: the old account you have with your former employers, an automatic safe harbor rollover account set up by your plan, the unclaimed property department in the state, or your old 401s could have been cashed out already if the balance was less than $5,000 when you left the job.

When you open an account with Bank of India, it offers a passbook to every account holder. The passbook keeps a record of all the transactions from the day of account opening. However, you need to update your passbook each time by visiting the bank branch. The IRS strongly encourages people to have all the information they need to file an accurate return to avoid processing delays. If the return includes errors or is incomplete, it may require further review while the IRS corrects the error, which may slow the tax refund.
To claim the 2021 Recovery Rebate Credit, individuals will need to know the total amount of their third-round Economic Impact Payment, including any Plus-Up Payments, they received. People can view the total amount of their third-round Economic Impact Payments through their individual Online Account. The IRS will also send Letter 6475 through March to those who were issued third-round payments confirming the total amount for tax year 2021. For married individuals filing a joint return with their spouse, each spouse will need to log into their own Online Account or review their own letter for their portion of their couple’s total payment.

What Happens To Old 401s
401 administrators have different procedures for what to do with left behind accounts. Depending on the amount, they could be distributed directly to you, transferred to an IRA on your behalf, or sent to a separate holding account until you claim them.
Unwilling to bear the burden of maintaining vast amounts of accounts from former employees, 401 plans prefer to unload them any way possible. This can make it challenging to find your old 401s.

Find Your 401s With Your Social Security Number
If you don’t have any of the information mentioned above, you’re not out of luck just yet. You can use your social security number to search for and find old 401s.
When you join a 401 at work, you’ll provide your social security number. This ties your 401 to any tax responsibilities you may have but also permanently stamps your 401 to your identity.
There are a couple of places to search for your old 401s using your social security number.
Option : Move The Money To Your New 401
If you have a new job with a new 401, your current employer may permit you to roll over your old 401 funds into your new account. However, not all plans allow this, so check with your company’s HR department or plan administrator to see if it’s an option for you.
If it is and you decide it’s your best move, you must choose between a direct and an indirect rollover. Direct rollovers are the better choice because you don’t handle the money at all. You just fill out a form telling your old plan administrator where to send the funds and they take care of it for you.
With an indirect rollover, the plan administrator cuts you a check for the funds in your account and you place that money into your new account. But if you fail to do this within 60 days of cashing out your old account, the government considers it a distribution and taxes you on that money for the year.
Before you decide to move your money to your new 401, make sure you like your investment options and are comfortable with the fees your new 401 charges. Many employers don’t allow you to transfer money out of your 401 if you’re a current employee, so once you transfer your old 401 funds to your new account, they could be stuck there, at least until you leave your current job.

The National Registry of Unclaimed Retirement Benefits helps employers connect with their former employees to returned unclaimed retirement accounts.
Using your social security number, they will search their database for any accounts associated with you. If one is found, they will provide you with the contact information for the plan’s administrator. Or if you’d like, they will contact your plan for you.
Then, you’ll receive information and a form to select how you want your 401 sent back to you.
This resource is only for unclaimed 401 reported by your former employers. If they havenât reported your 401, it will not show up in the database.
File Electronically And Choose Direct Deposit
The amount of the 2021 Recovery Rebate Credit will reduce the amount of tax owed for 2021, or, if it’s more than the tax owed, it will be included as part of the individual’s 2021 tax refund.
