For most small businesses, hiring a registered financial adviser to select, monitor and advise on plan investments is the surest way to protect against any potential ERISA violations and monetary risks. This is why almost all ERISA employer-sponsored 401 plans require their plan participants to select their investments from the bucket of investments selected by the registered financial adviser. These investments are typically always publicly traded mutual funds and/or exchange-traded funds. One of the reasons employers get sued because of a retirement plan is “inappropriate investment choices.”

So, holding alternative assets in a 401 plan, though legal, is not common because of the ERISA trustee fiduciary risks. However, it is possible your employer could allow you to invest in Bitcoin with your 401 funds. The advantage of using retirement funds to buy cryptocurrency is that all gains are tax-advantaged. So long as your 401 plan documents permit alternative assets and the plan trustee will allow the investment, you will generally be permitted to buy cryptocurrency in your 401 plan.

For example, my company, which establishes and administers self-directed retirement plans, allows its employees to buy Bitcoin with their 401 plan funds due to employee interest. As a plan fiduciary, my liability risks do increase however, we require each interested employee to sign various disclosure forms and only use a small percentage of their funds for Bitcoin investing.

    Who Can Add Bitcoin To Their 401k

    So far, Fidelity is the only company allowing for bitcoin in their 401 accounts. Accountholders will be able to purchase bitcoin in their 401 accounts, as long as their employer uses Fidelity to manage the accounts. Additionally, the employer must allow for the bitcoin purchase option in their plan.

    Other companies might also allow the purchase of bitcoin in 401 accounts later. Additionally, there is speculation that some other crypto assets might also be available at some point.

    Fidelity will limit bitcoin purchases to 20% of the retirement portfolio, although employers can set lower thresholds.

    This is a decision you will have to decide for yourself after doing your own research. I can give my opinion on the topic though, but this isnt advice.

    Many 401k plans, especially company-sponsored plans, will limit your exposure to the market. Its highly likely that you wont be able to find some or many of the ticker symbols that I mentioned in this post. So what can you do?

    One option is to convert the 401k into an IRA, which typically has less restrictive rules on what you can invest into. There are positives and negatives to this that you will have to weigh. For example, you can take out a loan on a 401k that you cant do in an IRA. There are probably also tax implications that I cant even go into detail on. I highly suggest you research the pros and cons of something like this before making a decision.

    If I were going to roll over a 401k into an IRA or open a new IRA account, would I open a traditional IRA or a Roth IRA? This one is a bit tricky. The simple explanation is that in a traditional IRA, the contributions are not taxed but the withdrawals are. With a Roth IRA, the contributions are taxed, but the funds can grow tax-free. This is a bit of a guess on where you think tax rates will be when you cash out and how much growth you think you will have.

    Should You Invest In Crypto Right Now

    Whether or not you should allocate a portion of your retirement savings toward Bitcoin will depend on your age and tolerance for risk.

    If you’re nearing retirement age, it may be best to avoid crypto altogether. Because it’s so risky and volatile, it could spell trouble for your retirement if it crashes. Similarly, if you’re a risk-averse investor, Bitcoin’s wild ups and downs could make it a stressful investment.

    On the other hand, if you have cash to spare and are willing to take a gamble, you may choose to invest a small amount in Bitcoin. There’s always a chance you could lose your investment, but you could also see substantial gains if Bitcoin succeeds. If you’re willing to take that chance, it may be the right investment for you.

    Just be sure, though, that you’re only investing money you can realistically afford to lose. Also, it’s important that the rest of your portfolio is well-diversified so that if Bitcoin fails, the majority of your money will stay safe.

    Bitcoin can potentially be a smart investment, but it’s not right for everyone. If you choose to invest, make sure you understand both the advantages and disadvantages. You cant defer the capital gains taxes until later if you decide to sell your digital assets. Now, though, if you can add crypto to your 401, you have the chance to defer some of your tax gains.

    Another advantage of holding crypto in your 401 is that you can take advantage of some of the potential gains. If cryptocurrencies and other digital assets catch on in the mainstream, theres an opportunity for huge growth. Capturing this growth in your retirement portfolio can go a long way toward helping you reach your long-term financial goals.

    Finally, holding crypto in your 401 offers the opportunity for diversity. So far, cryptocurrencies, especially bitcoin, have been moving in correlation to the stock market, but some enthusiasts believe that crypto will decouple from the stock market.     Despite the risks, at least one employer has signed up to offer Fidelity’s new product to its employees: MicroStrategy, a business and software services company. Its CEO, Michael Saylor, has been a vocal proponent of bitcoin.

    “MicroStrategy looks forward to working with Fidelity to become the first public company to offer their employees the option to invest in bitcoin as part of our 401 program,” Saylor said in a statement. “Teaming with companies like Fidelity that are innovating in bitcoin for corporations is important to us, as is furthering the development of the bitcoin ecosystem for institutional investors.”

    Morningstar’s Hume said MicroStrategy’s announcement is likely part of its brand to be first-movers in the cryptocurrency space. According to a company presentation, MicroStrategy currently holds 129,218 bitcoin at $30,000 apiece, it is worth a total of about $3.9 billion.

    So far, Fidelity is the only large retirement services platform or investment brokerage firm to offer a bitcoin 401 product. Vanguard said it had no plans to do so.

    “Since cryptocurrencies are highly speculative in their current state, Vanguard believes its long-term investment case is weak,” it said in a September 2021 note to clients its most recent opinion on the matter.

    Using A Ira Or 401 To Invest In Cryptocurrency

    You can use a self-directed IRA to invest in Bitcoin and other cryptocurrencies. However, options are limited with a 401. We discuss your options for investing in cryptocurrencies with a retirement account.

    NOTE: Below Ive done my best to research IRA and 401 crypto options, I however Im not a Retirement Plan Administrator, I am a researcher. So youll want to double check with a professional before taking the final leap.

    First off, what you can invest in with an IRA or 401 is defined not by what is allowed, but what is not allowed.

    In general the only things not allowed are life insurance contracts and collectibles .

    Meanwhile, cryptocurrency, being an investment property for tax purposes, is not expressly prohibited as an investment option, and thus can be considered an allowable investment for retirement accounts.

    While the above is true, you need specific types of accounts to be able to invest due to other rules that end up prohibiting cryptocurrency .

    Given the above, without going into detail, the bottomline here is that you need either a self-directed IRA or a Solo 401 to invest in cryptocurrency through a retirement account.

    The self-directed IRA one is a little more straight forward, what you need to do is 1. either set up an IRA limited liability company to purchase investment property , or 2. set up a Bitcoin IRA with a custodian like BitcoinIRA.com .

    So is it doable? YES. Is it easy? NO or simple not really .

    Is Bitcoin The Only Cryptocurrency

    No. Bitcoin was the first cryptocurrency and it is the best known, most widely held, andwith about 44% of the total cryptocurrency market cap2the most valuable. However, as of October 2021 there were thousands of digital currencies in the marketplace, of which more than 100 have a market capitalization exceeding $1 billion. Some of the more popular cryptocurrencies include Bitcoin Cash, Cardano, Tether, Ethereum, Polkadot, and XRP.

    In October 2021 Federal Reserve Chair Jerome Powell and SEC Chair Gary Gensler both stated that they didnt intend to outlaw cryptocurrencies, but Gensler said the SEC was exploring how best to ensure that the industry protects investors and consumers and follows anti-money laundering and tax compliance laws.

    China already has launched a digital yuan and it is estimated that at least 80 different countries around the world, including the United States, are exploring the idea of launching their own proprietary Central Bank Digital Currency. While the Fed, the U.S. Treasury and the SEC have been noncommittal on the topic, in October 2021 Powell remarked that it is more important to do this right than to do it fast. This implies that it may not be a matter of if but rather when the U.S. develops its own digital dollar.

    Is There Any Way To Invest Your Retirement Savings In Bitcoin

    If you’re really serious about making Bitcoin a part of your retirement portfolio, there are ways you can do it. If your employer offers a self-directed 401, you may be able to buy cryptocurrencies directly through that account. Check with the HR department to see if this is an option at your company, or to discuss the possibility of making it available to interested employees.

    You could also open a self-directed IRA. This is similar to a regular IRA, but it enables you to invest in some types of assets a regular IRA doesn’t, including cryptocurrency. This type of account isn’t as common as Traditional or Roth IRAs, so you’ll have to do some research to find out which brokers offer them. Look into the investment options, too, to make sure Bitcoin is a possibility. Not all self-directed IRAs offer the same set of investment choices, and you wouldn’t want to go through the trouble of opening one only to find out it’s not what you needed.

    Perhaps the best option for most people is to not invest their retirement savings in Bitcoin at all. Instead, invest some of your extra cash in Bitcoin through a cryptocurrency exchange. You won’t enjoy the same tax breaks that you’d get if you were holding those assets in a retirement account, but it will give you an opportunity to get some skin in the game without jeopardizing your retirement savings.

    Bitcoin Could Be A Smart Investment But It’s Not For Everyone
